1. Definitions
In these Terms of Service (the Terms):
- Site means the website operated at hopstarbrewery.co.uk, including all related pages, content, features and services accessible thereon.
- HopStarBrewery, we, us or our means the operator of the Site.
- User, you or your means any person accessing or using the Site, whether or not registered.
- Services means any online functionalities, information, content, digital tools, and, where applicable, e-commerce features made available via the Site.
- Content means all text, images, graphics, audio, video, logos, trademarks, trade names, software, code and other materials appearing on or provided through the Site.
2. Acceptance of the Terms
By accessing or using the Site, you confirm that you have read, understood and agree to be bound by these Terms. If you do not agree, you must not use the Site. If you use the Site on behalf of a business or other legal entity, you represent that you have authority to bind that entity and that the entity accepts these Terms.
3. Eligibility and Responsible Use Relating to Alcohol
- You must be at least 18 years old to access parts of the Site that relate to alcoholic products, and to purchase any alcoholic products via the Site. By using such parts of the Site, you confirm that you are 18 or over.
- Where purchases or deliveries of alcoholic products are offered, age verification may be required. We reserve the right to refuse or cancel an order or delivery if satisfactory age verification is not provided.
- We encourage responsible drinking. If you choose to consume alcoholic beverages, please do so responsibly and in accordance with applicable laws.
4. Access to the Site and Accounts
- We may update, modify, suspend or discontinue the Site or any part of it at any time without notice. We do not guarantee uninterrupted or error-free availability.
- Where account registration is offered, you must provide accurate and complete information and keep your credentials confidential. You are responsible for all activity under your account.
- You must promptly notify us of any suspected unauthorised use of your account or other security breach.

6. Purchases and E‑Commerce
- Where the Site enables the purchase of products or services, additional terms may be presented at checkout; those terms will apply in addition to these Terms. In the event of conflict, the terms presented at checkout will prevail in relation to your purchase.
- Prices, product descriptions and availability are subject to change. We take reasonable care to ensure accuracy but do not guarantee that descriptions or other content are error-free.
- We may refuse or cancel orders, including where a product is unavailable, there has been an error in pricing or description, or we suspect fraud, abuse or age-restriction non-compliance. If we cancel after payment, we will provide a refund of amounts paid for the cancelled items.
- Your statutory rights are not affected.

- The Site and all Content are owned by us or our licensors and are protected by copyright, trade mark and other intellectual property rights.
- HopStarBrewery names and logos are our trade marks. Other names and logos may be trade marks of their respective owners.
- You may view the Site and print or download extracts for your personal, non-commercial use only, provided you do not modify the materials and you keep intact all copyright and proprietary notices.
- Except as expressly permitted by these Terms or by mandatory law, you must not use, reproduce, distribute, modify, create derivative works from, publicly display, perform, republish, download, store or transmit any Content without our prior written consent.
8. User Contributions
- If the Site allows you to submit reviews, comments or other materials (User Content), you grant us a worldwide, non-exclusive, transferable, sublicensable, royalty-free licence to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute and display such User Content in connection with the Site and our business.
- You represent and warrant that you own or have the necessary rights to submit your User Content and grant the above licence, and that your User Content does not infringe any rights of third parties or violate any law.
- We may remove or disable access to any User Content at our discretion, including if we believe it violates these Terms or applicable law.

- To the fullest extent permitted by law, our total aggregate liability to you arising out of or in connection with the Site or these Terms, whether in contract, tort (including negligence), breach of statutory duty or otherwise, shall be limited to the greater of: (a) one hundred pounds (£100); or (b) the total amount you paid to us via the Site in the twelve months preceding the event giving rise to the liability.
- If you are a consumer, we are responsible for loss or damage you suffer that is a foreseeable result of our breaking these Terms or our failing to use reasonable care and skill, but we are not responsible for any loss or damage that is not foreseeable.
- Your statutory rights are not affected.
13. Indemnity
You agree to indemnify and hold us harmless from and against all liabilities, losses, damages, costs and expenses (including reasonable legal fees) arising out of or in connection with your breach of these Terms, your misuse of the Site, or your infringement of any intellectual property or other rights of any person or entity.

16. Applicable Law and Jurisdiction
- These Terms and any dispute or claim arising out of or in connection with them or their subject matter or formation (including non-contractual disputes or claims) are governed by and construed in accordance with the laws of England and Wales.
- The courts of England and Wales will have exclusive jurisdiction to settle any such dispute or claim. If you are a consumer resident in Scotland or Northern Ireland, you may bring proceedings in your local courts.

- Severability: If any provision of these Terms is found to be invalid or unenforceable, that provision will be enforced to the maximum extent permissible and the remaining provisions will remain in full force and effect.
- No waiver: No failure or delay by us in exercising any right or remedy under these Terms shall operate as a waiver of that right or remedy.
- Assignment: You may not assign, transfer or subcontract any of your rights or obligations under these Terms without our prior written consent. We may assign or transfer our rights and obligations under these Terms to another organisation.
- Entire agreement: These Terms constitute the entire agreement between you and us regarding the Site and supersede all prior or contemporaneous understandings relating to the Site.
- Force majeure: We will not be liable for any delay or failure to perform our obligations under these Terms to the extent caused by events beyond our reasonable control.
- Notices: We may provide notices by posting them on the Site or by using any contact details you have provided. You agree that electronic communications satisfy any legal requirement that communications be in writing.
